Terms & Conditions

We are delighted to welcome you to Tinlids and pleased that you have chosen our Agency.

We look forward to developing a long and positive relationship with you and fostering a successful and enjoyable experience in the entertainment and commercial industry, which we hope may be the start of a longer term interest for you.

This agreement sets out our responsibilities and commitment to you, as well as your responsibilities to us, . This agreement creates a binding agreement between us, so please read it carefully. If you have any questions, we would be pleased to discuss them with you. This agreement is between the Parent or Guardian of the child, for and on behalf of Tinlids Model Agency, 12 Byron Street, Box Hill South Vic 3128, ABN 87 253 629133.

This agreement must be accepted by the Parent or Guardian of a prospective Tinlids Member in order for the membership to become valid. If the Parent or Guardian agrees to their child becoming a Member, this constitutes acceptance of this agreement.

Membership - Membership entitles you to the following

full studio shoot with two outfit changes
six shots selected and uploaded onto the Tinlids Model Agencies website.
There will also be an opportunity to purchase through the commercial photographer any additional photos if desired.

Online membership and access to www.tinlidsagency.com.au. The key to making the most of being part of Tinlids.

Fees - The fee charged consists of the joining process, representation for a 12 month period and the photographic shoot taken for the Tinlids web site.

Payment Terms - Fees can be paid by credit card, cash, cheque, eftpos and direct transfer on joining. If you do not pay the full amount owing to , under certain provisions of the 'Privacy Act 1988' Tinlids may give information about you to a credit reporting agency.

Members may cancel their membership after the expiry of one year or at any time during the duration of presentation by giving written notice to Tinlids. Tinlids may change these terms and conditions by giving 30 days notice to the member of its intention to do so.

AGENCY Appointment - Our commitment is to provide you with the highest level of professional service, to give you timely, courteous and helpful attention, and to do so in a warm, friendly and ethical environment. Whilst we cannot make any guarantees about your future, we will be committed to optimising each opportunity for you to translate this into work in the Entertainment and Commercial Industries.

The Parent appoints Tinlids as manager and agent for the Member. In this capacity, Tinlids will:

1) Act as the exclusive representative in Australia to procure engagements and bookings with Clients on behalf of the Member, and

2) Act as your non-exclusive global representative outside Australia in regard to booking enquiries received from outside Australia.

Note: there is no obligation or expectation on behalf of the Member to make themselves available for international work. All such enquiries will be discussed with the Parent prior to submitting the Member for such engagements.

3) Provide continuing career or artistic advice for the member;

4) Provide services ancillary to a performance by the member;

5) Represent the member in negotiations with media, entertainment industry workers or the public;

6) Publicising and promoting the member;

7) Notify them of development opportunities that may be available to assist in the procurement of work by the Member.

Term of the Appointment - The appointment lasts for a term of 12 months commencing on the date of this agreement, or until terminated by 30 days notice.

Fee and Commissions - Tinlids, as the Member's agent and manager, will collect any fees payable to the Member or the Parent, for and on behalf of the Member, under Booking Agreements, and will remit any fee collected to the Parent, less an agreed amount as the fee to the agency for its representation services. This is 20% commission. The commission retained by Tinlids excludes GST.

Listing Requirements For The Tinlids Database - The Parent or Guardian is required to pay an initial membership fee. That fee includes a photography session The Membership fee is payable prior to the Member attending their photo shoot with Tinlids. The fees payable by the Member under this clause include GST. The Parent or Guardian grants Tinlids and its representatives/associates an exclusive, transferable licence to use the information supplied in relation to the Member for the purpose of exercising its rights and performing its obligations under this agreement, including securing and completing a photography booking. It is understood that a third party photographer will be engaged and Tinlids will therefore be required to distribute personal information of the member outside of the organisation for this purpose. The member agrees that they have no objection to this or the use of their personal information in any other manner.

The Parent consents to the use of all information they provide under this agreement in accordance with Tinlids Model Agency's Privacy Policy, which is available on request. Without limiting any other clause of this agreement, the Parent or Guardian is responsible for all information and materials which they provide under this agreement; must ensure all information provided is as accurate, up-to-date, and as comprehensive as possible, presented in professional manner, complies with all relevant laws, regulations and codes of practice, does not infringe any person's rights and does not contain any viruses or anything else which may interfere with a computer system. The Parent or Guardian acknowledges that: inclusion in any of Tinlids products does not represent that the Member will receive any requests to attend casting or booking sessions. Tinlids is under no obligation or liability to the Parent or the Member in the event that the Member is not requested by a Client through Tinlids to attend a casting session or booking; Tinlids is not required to promote the Member or provide any services except as expressly set out in this agreement.

Liability For Expenses - Tinlids will not be liable for any expenses which the Parent or Member incurs in the course of providing Services.

Change Of Appearance - Where the Member has attended a casting session for a Booking Agreement, the Parent must ensure that the Member does not change his or her appearance before the completion of the Booking Agreement without the prior approval of Tinlids.

General conditions - Health & injuries - We accept children on the assumption that they are in good health and it is your responsibility to alert us to any medical complaint or history suffered by your child. We do not accept responsibility for loss or damage arising from errors or omissions on the Registration Form whether completed by you or by another person in charge of your child at the time of completion. We do not accept liability for death or personal injury to any child attending job bookings or any activity related to a booking whether organised by Tinlids Model Agency or otherwise save to the extent that such injury shall be caused by the negligence or default of any member of our staff or any other default on our part.

Personal property - We do not accept responsibility for any loss of, or damage to, personal property belonging to you or your child irrespective of whether such possessions might be used by you or the child for the purposes of any booking save to the extent that such loss shall be caused by the negligence or default of any member of our staff or any other default on our part.

Other losses - We do not accept responsibility for any loss or expense due to circumstances beyond our control, including, but not limited to, delays in public transport, weather, quarantine, sickness, bereavement, strikes or other industrial action, terrorism, fire and riot. Without prejudice to the other terms of this agreement, in no event (including our own negligence) will we be liable for any:

a) economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings);

b) loss of goodwill or reputation;

c) any other special, indirect or consequential losses; or

d) loss to third parties.

e) consequential losses of any nature at all where incurred directly or indirectly by any activity with Tinlids. This clause applies to the entire agreement and not just the agency portion and on all locations.

Termination Of Agency Agreement - Either the Parent / Guardian or Tinlids Model Agency may terminate this agreement, for any reason whatsoever, by the giving of 30 days notice in writing to the other party. Tinlids may terminate this Agency agreement immediately by notice in writing to the Parent or Guardian if the Parent, Guardian or the
Member breaches this agreement. In the event of termination, Tinlids:

(i) is not obliged to refund any membership fees paid ;

(ii) must deactivate and, if practicable, destroy all copies of the Member's information within its possession or control and may no longer act as the Member's agent and manager;

(iii) within 30 days of the date of termination, pay any fees, less commissions, collected on the Parent or Member's behalf except to the extent that the Parent or Member is in breach of this agreement and Tinlids Model Agency has collected fees on behalf of the Parent or Member which relate to a booking in respect of which the Member breached this agreement, in which case Tinlids Model Agency may retain those fees, and which is only one of the actions which Tinlids Model Agency or the relevant Client may take in response to the Parent or Member's breach of this agreement. All provisions of this agreement that are capable of continuing or which by their nature should continue, survive any termination of this agreement.
